Program Terms & Conditions

This Agreement is made among The Edvisory (“Advisor”),(“Responsible Party”), and (“Student”).
The Advisor, the Responsible Party and the Student agree as follows:
1. Services. In one-on-one and small group sessions, the Advisor helps students optimally position themselves for college or graduate school. Our process emphasizes self-discovery, personal growth, understanding the Student’s key strengths and passions and positioning the Student’s application materials (applications, resume, essays) to optimally market the Student for these purposes to become a more competitive applicant.
2. Programs. The Advisor will provide to the Student, and the Responsible Party agrees to pay for The Roadmap: College Admissions Consulting services for a period of up to 12 months from the start date (but in no event more than 10 college applications) at the fees listed in paragraph 4 on the terms and conditions set forth in this Agreement. This program does not include applications to specialized programs or international college applications. Services related to specialized programs or international college applications are billed at an additional cost which will be quoted by Advisor upon request.
3. Sessions. The services will be provided via online conference or telephone call.
Responsible Party and Student agree to give the Advisor 48 hours’ notice of cancellation (barring a true emergency). If Student misses a scheduled meeting without providing the Advisor with such notice, such session will be deemed used and forfeited.
4. Our Fees. The Roadmap: College Admissions Consulting - Fee of $39,500 (pay in full)
Responsible Party may select a payment plan consisting of a deposit of $10,000 and twelve (12) monthly payments of $2,500. The initial payment will consist of the deposit ($10,000) and the first month’s payment ($2,500) for a total initial fee of $12,500 and a total fee of $40,000.
The Package consulting fee is payable regardless of participation by the Student and regardless of acceptance of the Student at the college, graduate or professional school (each being referred to in this Agreement as a “school”) of his or her choice.
All purchases are nonrefundable at the time of payment and non-transferable.
If Responsible Party selects to pay in installments, Responsible Party agrees to pay the entire purchase price and to make all installment payments on time and in full and Responsible Party agree that regardless of the number of sessions Student participates in, Responsible Party must pay the entire purchase price in full and on time. If Responsible Party fails to make any payment on time, Responsible Party agree that Advisor may terminate this Agreement.
Failure to make payments on time will result in your owed balance being referred to an external party for debt collection. Any fees charged by the external party will be added to owed balance.
5. Services. The Advisor will provide and assign a coach to the Student. The coach will be Cathleen McCaffery or another member of The Edvisory team or Cathleen McCaffery and a coach. The coach will guide the Student’s process of self-discovery based on interview, testing, prior academic record, and any other input provided by the Student. The coach will assist the Student in developing an optimal positioning and communication strategy. The coach will brainstorm with the Student a list of potential schools based on the Student’s indicated interests. The coach will assist the Student in developing a strategy for applying to potential schools. The coach will provide direction on researching schools and programs.
The coach will brainstorm with the Student on topics for essays and short form answers and will help develop the outline of the essays. After the Student prepares drafts of the essays, the coach will help edit grammar, spelling and elements of style. It is essential that the Student draft and redraft the essays himself so that the essays represent the Student’s own work. The coach will assist the Student with the preparation of a resume based upon the Student’s initial draft. The coach will assist the Student with selection of recommenders and preparation of a cover letter to recommenders based upon the Student’s initial draft.
The coach will not be responsible for the actual filling out of application forms but will assist the Student by answering questions about applications or advising the Student about how to find answers.
This package includes a maximum of 26 60-minute sessions (typically twice monthly or weekly depending on the agreed upon timeline) conducted via video conference, a maximum of 4 30-minute parent meetings (typically once per quarter), access to Cathleen or your coach and The Edvisory team via messaging app and email for questions and revisions and access to custom resource folder. Up to 4 (four)additional sessions for an extra college application to be used over a period of 30 (thirty) days may be purchased at $2,500 USD if needed.
6. What We Expect.
The Responsible Party is the parent or legal guardian of the Student.
The Responsible Party and the Student will disclose to the Advisor the Student’s academic record and psychological history, the Student’s expected collegiate course of study and career interests and the colleges to which the Student intends to apply.
The Student will prepare for each session and will complete assignments given by the Advisor promptly and thoroughly. The Student will take responsibility for researching schools and programs as directed by the Advisor. The Student will bring copies of necessary materials to the sessions as requested by the Advisor.
Internal deadlines are expected to be met as they are assigned to keep the Student on track for external deadlines. The Advisor will need at least ten (10) business days before any external deadline or timely feedback is not guaranteed. If internal deadlines are not met, we cannot guarantee readiness for external deadlines.
The Responsible Party agrees to attend sessions with the Student if so requested by the Advisor.
Responsible Party and Student agree to inform the Company and Cathleen McCaffery in writing of any issues or concerns with the assigned coach or the services via info@theedvisoryla.com and cathleen@theedvisoryla.com . Failure to provide such written notice during the term of this Agreement constitutes a waiver by Responsible Party and Student of any such claims.
7. Certain Limitations. The services provided by the Advisor are strictly advisory. If requested, the Advisor will make suggestions regarding schools and may refer the Student to resources about a particular school, if known to the Advisor. The Student and the Responsible Party will select the school to which application will be made and which school the Student will attend from among those which offer the Student admission. The Advisor will not contact the Student’s current school or any other party to discuss the Student’s application process or academic record. The Advisor will not contact any school on behalf of the Student for any purpose whatsoever (certain exceptions may be made).
Advisor assumes no responsibility under this Agreement other than to perform the services in good faith, and the Advisor is not responsible for any consequences whatsoever that result from any action of Responsible Party or Student in following or declining to follow any advice or recommendation of Advisor. Any and all decision-making, including without limitation whether or not to follow any advice by Advisor, is solely the responsibility of Responsible Party and Student.
Except as expressly provided in this Agreement, the Advisor makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the services rendered.
In no event will the Advisor be liable to Responsible Party and Student for any indirect, consequential, incidental, or special damages. In no event will the Advisor’s liability arising out or relating to this Agreement, whether arising out of or related to breach of contract, tort (including negligence) or otherwise exceed the amount paid or payable to the Advisor under this Agreement.
8. RESPONSIBLE PARTY AND STUDENT RESPONSIBILITIES INCLUDE:
Disclosing truthful academic and psychological history in a timely manner, including transcripts, official score reports from standardized tests, extracurricular involvement, and reports of any disciplinary action
Maintaining regular communication with The Edvisory Team/Cathleen, responding to emails and messages within 48 hours
Meeting deadlines for completion of assigned tasks and drafts, as agreed upon in sessions, via email and the Action Items document
Scheduling of and making college visits (if applicable)
Maintaining communication with the student’s high school counselor and following the requirements of the student’s high school guidance office
Registering for standardized testing and sending official test scores to colleges
Securing academic, counselor, and personal recommendations
Completing all financial aid applications on time, including the FAFSA and CSS Profile (if applicable)
Filling out appropriate applications (Common App, Coalition Application, University of California, ApplyTexas, etc.), keeping track of all college application deadlines, and submitting applications (or waitlist/appeal statements) in a timely manner
Ensuring that all details in application, including major selection, demographic information, etc. are correct
Monitoring status of application and advising colleges of enrollment intentions
Writing for the application must be the student’s own original work
9. End of Services
The internal deadline for Early Action/Early Decision schools is October 15th. The final goal for having all applications done is November 1st. Drafts of all applications with Early Action/Early Decision deadlines of November 15th must be submitted to coach and Cathleen McCaffery by October 15th.
The official end of services date is December 15th of your application year for all Regular Decision Applications OR 12 months after the start date for students who begin in 9th or 10th grade or 11th grade or transfer students (the end of services date is a maximum of 12 months after Student begins). You will have access to your coach for revisions until this date. (Access to coach may be extended beyond that date pending coach availability for an additional fee.) Any unused session will be forfeited at the official end of service date.
Students can extend their end of service date as per coach availability for an additional fee of $1,500 USD per 2- week period (this includes 2 additional 60-minute meetings and M-F email access and offline editing.
10. We Cannot Guarantee Acceptance. The Responsible Party and the Student understand that the application process is complex and uncertain, and that the decision to accept or reject an applicant is in the control of the school and not within the control of the Advisor. The Advisor does not guarantee acceptance into any school.
11. We request the following:
1. Essay sessions happen with the Student only. The Responsible Party is invited at the start of the process to have input through the parent questionnaire (or through the student and via email once the process has begun), but we prefer that parents/guardians not be involved in essay sessions. The Responsible Party is welcome to join for college counseling and list development sessions with your coach.
2. We prefer to communicate directly with the Student on questions regarding the application process, scheduling, and keeping on task. If we sense the Student is behind, or hasn't replied to two consecutive attempts at contact, we will reach out to the Responsible Party and share any concerns.
12. Miscellaneous. Either party may terminate this Agreement with immediate effect upon written notice to the other party, with or without cause. The Advisory may, in its sole discretion, terminate this Agreement without prior notice and without cause. The Responsible Party agrees that the Advisor may limit, suspend, or terminate the Student’s participation in the Program without refund or forgiveness of payments if, at the sole discretion of the Advisor, the Student and the Responsible Party (a) fail to attend two meetings during the service period or (b) fail to respond to email or other communications for a period of 30 days or more. There are no refunds for services paid. Payment will be due immediately for services rendered. This Agreement is personal to Responsible Party and Student and therefore Responsible Party and Student may not transfer or assign this Agreement.This Agreement shall not be transferred or assigned by either party. This Agreement shall be governed by the laws of the State of California. If any term or provision of this Agreement is to any extent held to be invalid, illegal, or unenforceable by any court of competent jurisdiction, the remainder of this Agreement will not be affected thereby, and each term and provision of this Agreement will be valid and enforced to the fullest extent permitted by law. If any arbitration, proceeding, suit, or other action is instituted to interpret or enforce the provisions of this Agreement, to rescind this Agreement, or otherwise with respect to the subject matter of this Agreement, the party prevailing on an issue will be entitled to recover with respect to such issue, in addition to costs, reasonable attorney fees incurred in the preparation, prosecution, or defense of such arbitration, suit, or action as determined by the arbitrator or trial court, and, if any appeal is taken from such decision, reasonable attorney fees as determined on appeal. This Agreement may not be amended, altered or supplemented except in writing signed by both the Advisor and Responsible Party.
